Women experiencing a divorce have many unique issues that they should consider. These include:

Living Arrangement:If you have children and intend to have their primary care, you should consider staying in the family home. The statute actually favors giving the family home to the primary residential parent. Typically the major concern is the ability to afford to pay the mortgage, but that is something that spousal maintenance can be used for.

Child Support for Women:  If you have children and plan to be the primary caregiver, your spouse will probably have to pay child support. The statutes spell out exactly how child support is calculated, but it is primarily based upon the comparative net incomes of the parties, and the number and age of the children.

Spousal Support for Women: Spousal maintenance is intended to assist the more dependent spouse in transitioning to financial independence. This is especially ture for women. Something to keep in mind is that spousal maintenance is taxable income.

Separate and Community Property: The court has a lot of discretion in the division of assets in a divorce. It is important to gather documentation to verify all separate (per-marriage and inherited) property. Try to document the existence of your husbands life insurance policies, 401(k)’s, IRA’s, pensions, stocks and investments, and other benefits.

Health Insurance for Women: If you are covered under your husband’s insurance, the court will usually continue that until the entry of the Decree. You will then be required to get your own coverage, however, you may be able purchase COBRA coverage from his employer.
