Fatherhood: Sometimes men must fight for their parental rights. Negotiating child custody and visitation rights are not always easy. Because of societal prejudices against fatherhood, men need to take specific steps to prove that they are committed, loving, responsible parents.
Living Arrangement: If possible, it is best that you not move out of the family residence right away for several reasons. Obviously it is less expense if you don’t have to pay rent on another home. Leaving the home will make it more difficult for the court to ultimately award you the home in the property division if that is your desire. Leaving the children with your spouse in the home is likely to be interpreted by the court that you believe that this is in the best interest of the children long term. Additionally, you allow your spouse to have the upper hand on your visitation until you can get into court to establish a Parenting Plan.
Spousal Support for Men: Spousal maintenance is intended to assist the more dependent spouse in transitioning to financial independence. Historically this has been for the wife, however, in today’s economy, it can also be for the husband who is less financially able, whether he is out of work or suffering from poor health. Spousal maintenance for men has become more common, and may be something to which you are entitled.
Separate and Community Property: The court has a lot of discretion in the division of assets in a divorce. It is important to gather documentation to verify all separate (per-marriage and inherited) property and community property as well. It become more difficult to gather this information after separation.
